An 80-year-old Villager will not be prosecuted in a case in which a nurse reported seeing him slap a woman at Freedom Pointe assisted living facility in The Villages.
Robert John Marinaccio of the Village of Lynnhaven had been in the room of the woman in May at Freedom Pointe when a nurse overheard a verbal argument. When the nurse went into the room to investigate, she saw Marinaccio slap the woman, according to an arrest report from the Sumter County Sheriff’s Office.
Marinaccio left the facility before law enforcement arrived. When he was interviewed at his home on Utica Way, he told a deputy that he and the woman, who recently had hip surgery, had been arguing about him not getting her to the bathroom quick enough. He denied slapping the woman.
Last month, State Attorney Brad King announced that no information would be filed in the case due to “victim/witness issues.”
Marinaccio was represented by attorney Jody Lynn Fisher.
