A Summerfield woman and an Ocklawaha man were arrested earlier this week after a woman reported that she and her 10-year-old daughter witnessed a sex act in progress at an intersection in Belleview Heights.
The woman spoke to a Marion County sheriff’s deputy on the phone Sunday and told him that she and her daughter were on the way home when they witnessed the sex act at the intersection of SE 142nd Lane and SE 38th Terrace.
The woman said that as she approached a black Ford that was parked on the road, she saw 21-year-old Zackery A. Davila standing outside the rear passenger door of the vehicle with the door open. She said she then observed the top of 18-year-old Samantha Forrest Stone’s head even with Davila’s waist area, a sheriff’s office report states.
The woman said they passed by the black Ford and she saw her daughter looking back toward the vehicle. She said looked her in rearview mirror and realized that that Davila wasn’t wearing pants. She said she pushed her daughter’s head down so she wouldn’t see the sex act that was taking place And she stopped her vehicle, told Davila and Stone “to get out of here” and then called 911.
A sheriff’s deputy made contact with Davila, who lives at 15001 SE 100th Street in Ocklawaha. He said that he had picked up Stone from her father’s residence and then parked the vehicle at the intersection in Belleview Heights. He said he got out of the car and went to the rear passenger door as Stone moved to the rear seat. And he claimed he stood outside the car as she allegedly performed the sex act on him, the report says.
The deputy then spoke to Stone after locating her in the 12100 block of SE 135th Avenue carrying a black backpack. Stone, who lives at 14881 SE 41st Ct. in Summerfield, confirmed that Davila picked her up at her father’s house and later parked in the intersection. She said she already was sitting in the rear seat and claimed Davila was standing at the vehicle’s rear door while changing his shorts. And she denied performing a sex act, the report says.
Davila was taken into custody at 3260 SE 80th Street and booked into the Marion County Jail at 3:23 a.m. Monday, where he was charged with exhibition of lewd and lascivious behavior in front of a victim less than 16 years of age and possession of drug equipment. He is being held on $1,500 bond and is scheduled to appear in a Marion County courtroom on May 7 at 9 a.m. to answer to the charges.
Stone also was taken into custody at 3260 SE 80th Street, booked into the jail at 3:29 a.m. and charged with exhibition of lewd and lascivious behavior in front of a victim less than 16 years of age. She is being held on $500 bond and also is due in court on May 7 at 9 a.m.
Stone is no stranger to the Marion County legal system, having been arrested May 20, 2018 and charged with grand theft of a motor vehicle. She was found guilty and sentenced to four months in the Marion County Jail.
