Montgomery explained there was a verbal altercation Thursday morning, which involved both parties. A man came up to him with a stick, dropped it and proceeded to slap him, the report said.

The deputy then spoke with the victim who advised that Montgomery walked down several houses from his residence and approached the employees at 21423 SW Peach Blossom St. He kept trying to get in the victim’s face, and the victim stated if he did not stop, he would defend himself. Montgomery instead bumped chests with the victim, to which he struck Montgomery in the face, the report said.

The victim stated he feared for his life due to Montgomery being twice his size. He repeatedly told him to back up, the report said.

Montgomery was ultimately arrested for battery and transported to Marion County Jail. He was released after posting $1,000 bond.
