A Summerfield man was arrested after allegedly slapping his girlfriend’s phone out of her hand to prevent her from recording an argument over infidelity.

A deputy responded to a physical disturbance at an undisclosed Marion County residence on Thursday evening, according to an arrest report from the Marion County Sheriff’s Office. Once at the scene, he observed 30-year-old Logan James Dakan standing outside his truck and his live-in girlfriend, the victim, sitting on the porch.

The deputy first spoke to the victim who advised that since 5:30 p.m., they had been arguing back and forth through text over her accusing him of cheating on her. They continued arguing when Dakan came home. To avoid this, the victim took her five kids, put them in a van and left for about an hour and a half, the report said.

When the victim got home, she and Dakan continued arguing over infidelity. She started recording while in the kitchen because he was getting irate and yelling at her. As she recorded, he slapped the phone out of her hand, which caused the phone to hit her chin, the report said.

The deputy watched the video and saw Dakan get in the victim’s face. He told her to stop harassing him, cursed at her and slapped the phone out of her hand. There was also a juvenile witness standing by them during this altercation, the report said.

The juvenile witness stated Dakan was calling her mother, the victim, bad names and hitting the phone out of her hand, the report said.

The deputy then talked to Dakan who admitted to losing his temper and knocking the phone out of the victim’s hand, the report said.

Dakan was subsequently arrested and charged with battery. He was transported to Marion County Jail to be held without bond.
