A Spruce Creek South man was arrested for battery after allegedly punching his girlfriend during an argument sparked by her not wanting to provide him with oral sex.
A deputy responded to a domestic disturbance at a Spruce Creek South residence in Summerfield on Saturday, according to an arrest report from the Marion County Sheriff’s Office. Upon arrival, he met with the girlfriend of 53-year-old Nicholas Sebastian Gallina. She was crying and highly intoxicated.

She advised that they were discussing past relationships when Gallina got upset for no reason, punched her and slapped the right side of her face. The argument started over her not wanting to give him oral sex. She told him so, to which he battered her and went to his bedroom, the report said.
The deputy then spoke to Gallina, who was also very intoxicated. He stated there was no arguing, only a disagreement over alcohol. He did not want his girlfriend drinking anymore, so he took the bottle of alcohol back and went to pour it down the kitchen sink, the report said.
She took the bottle back, and he separated himself by going to his bedroom. He denied having an argument over sex or battering her in any way, the report said.
At around 4:40 p.m. Sunday, the deputy came back to the residence to follow up with the girlfriend. She advised that her face was starting to bruise, and the deputy saw discoloration on the right side of her face close to her temple. This was consistent with being struck about 24 hours prior, the report said.
The girlfriend was sober at the time and gave a similar statement to what she said the night before. She held that the argument started over sex but could not remember what they were arguing about when Gallina struck her, the report said.
Gallina was ultimately arrested on charge of simple battery (domestic) and transported to Marion County Jail. Bond was set at $1,000.
