A Villager who has filed a lawsuit against Walmart claims she slipped and fell on an uneven surface in the parking lot of one of the company’s locations in The Villages.

Attorneys representing Barbara Pivko filed the lawsuit against Wal-Mart Stores East, LP, in the Fifth Judicial Circuit Court of Sumter County on August 6.

Pivko claims she was visiting the Walmart at Buffalo Ridge Plaza in The Villages, which is located at 4085 Wedgewood Lane, on June 17.

As Pivko was walking from the store to her vehicle, she claims she tripped and fell over an “unmarked change of elevation in the concrete walkway of the parking lot.”

Pivko’s attorneys, Orlando-based Morgan & Morgan, argue that the company was negligent in maintaining the parking lot and external walkways at the facility. They claim their negligence created a “trip hazard” and “unreasonably dangerous condition.”

Pivko’s attorneys claim the business failed to inspect its parking lot and determine whether or not “the unmarked change in elevation in the concrete walkway in the parking lot constituted a trip hazard or” unreasonably dangerous condition.

As a result of the alleged fall, Pivko allegedly sustained bodily injuries, a loss of the ability to earn money, and an aggravation of a pre-existing condition. The losses are described as permanent or continuing in nature.

Pivko, who lives in the Village of Bonnybrook, is seeking over $50,000 in damages, exclusive of attorney’s fees.
