A resident of Del Webb Spruce Creek in Summerfield was arrested for allegedly slapping her husband when he called emergency services for her.
A deputy responded to the home regarding a physical disturbance between 75-year-old Frances Ellen Rubenstein and her 85-year-old husband at 10:30 p.m. Monday, according to an arrest report from the Marion County Sheriff’s Office.

The husband advised that Rubenstein slapped him, leaving him with a red bruise on his right cheekbone. She had been upset about something and complained of shortness of breath. So, he called emergency services, which upset her. She then grabbed his phone and struck him in the face, the report said.
But she claimed her husband was crazy, and nothing happened between them. She denied hitting him or trying to take his phone. She only admitted to getting upset with him because he was acting erratic due to his Parkinson’s disease and health issues, the report said.
However, the report noted the husband was in a coherent state of mind during his interview and seemed articulate in his testimony.
Rubenstein was subsequently arrested on charge of battery on person 65 years of age or older (domestic). She was booked at the Marion County Jail where she was initially held without bond.
