
The Amenity Authority Committee remains deadlocked on passage of an interlocal agreement that would green light golf cart striping in Community Development District 4.
AAC member Rich Lambrecht has been sidelined from participation in both the AAC and CDD 4, on which he serves in an elected capacity. Prior to suffering a stroke earlier this year, Lambrecht had championed striping on golf cart paths.
However, golf cart path striping has been on a rough ride, being rejected by CDDs 1, 2 and 3. The, golf cart path striping was also the subject of a deadlocked vote in which Village Center Community Development District AAC member Gary Moyer attempted to cast a tie vote. When an attorney opinion disallowed Moyer’s vote, AAC member Jo Weber attempted to change her vote from “yes” to “no.”
For the moment with Lambrecht out indefinitely, the matter remains deadlocked with Weber and Ann Forrester opposing and Carl Bell and John Wilcox favoring.
The interlocal agreement would simply allow the AAC to pay for the striping in CDD 4.
Gary Moyer’s Amenity Authority Committee vote last month against golf cart path striping has been disallowed.
The legal opinion was announced this morning in the AAC meeting.
In February, Moyer, who serves on the AAC as a representative of the Village Center Community Development District Board, voted along with AAC Chair John Wilcox and AAC member Ann Forrester against paying for striping the paths. The vote had deadlocked 3-3,
“The striping in my opinion included in the term ‘operation and maintenance’ and therefore Mr. Moyer could not vote against the majority and must vote with the majority on this issue,” VCCDD District Counsel Lewis Stone wrote in an opinion unveiled at today’s meeting. “Therefore, it is my opinion that the measure passed 4 to 2 and that the recording secretary is to show with explanation that Mr. Moyer’s vote is in the majority as required by the Settlement Agreement.”
Moyer is also vice president of development for The Villages.
Lady Lake/Lake County AAC member Jo Weber, who voted to fund the striping in February, said today she wanted to change her vote and wanted to revote. She then changed her motion to “reconsider” the vote, which was seconded by Forrester.
The motion to reconsider the vote failed with Lambrect, Wilcox and Carl Bell voting against it. Forrester and Weber voted in favor of it. Moyer did not vote.
The AAC had previously offered to pay for striping in Districts 1, 2, 3 and 4. Only District 4 accepted the offer.
CDD 4 Chairman Don Deakin said he had been “absolutely appalled” that the AAC had offered to pay for the striping and then tried to take back their offer.
