The attorney for Villager Margaret “Peggy” Klemm, the woman charged in the infamous “Sex on the Square” episode, said it is increasingly likely he will take her case before a jury.
He said the prosecution’s offer to his client is one-year in jail.
“That is not something we are willing to entertain,” said Klemm’s defense attorney, Joseph Indelicato.
His 68-year-old client remains in the Sumter County Detention Center without bond on a probation violation.
On July 2, the man arrested with her June 2 at Lake Sumter Landing Market Square was sentenced to six months in jail for his role in the sexual tryst. David Bobilya, 49, of Summerfield, is also being assessed a $50 charge for each day of his incarceration.
“It was certainly surprising to see that sentence handed down,” Indelicato said.
Since the pair was arrested, the case has set off a firestorm of publicity attracting unwanted attention around the globe.
Klemm is facing misdemeanor charges of indecent exposure and disorderly conduct. She had been arrested on a charge of driving under the influence in April while operating a golf cart in Lake Sumter Landing. That charge was reduced to reckless driving and on May 30 she was placed on probation. Three days later, she and Bobilya were arrested by a Sumter County sheriff’s deputy while they were on stage at Lake Sumter Landing, allegedly unclothed and having sex. Initially, she made bond, but later surrendered herself on the probation violaton.
