An Oxford man was caught driving an unregistered ATV and subsequently refused to provide a urine sample for law enforcement.
Llewellyn Guy Gordon, 52, was arrested Monday evening after a Sumter County Sheriff’s Office deputy spotted him operating a gas-powered, four-wheel all-terrain vehicle near the intersection of County Road 222 and County Road 235A in Oxford. The ATV had no visible Florida registration or vehicle identification number.
During the traffic stop, the deputy noted that Gordon had slurred speech, bloodshot and watery eyes, and the odor of alcohol on his breath, according to an arrest report. Gordon was also observed drinking from a white Styrofoam cup. While the deputy was running Gordon’s information, Gordon stood up and dumped the cup. The deputy later recovered the empty cup and noted it still smelled like alcohol.
A records check revealed Gordon’s driver’s license had five active suspensions and revocations, including a five-year revocation issued in November 2022 for a previous DUI. Gordon’s history includes two prior convictions for driving with a suspended license and two prior DUI convictions in Sumter County in 2018 and 2022.
Gordon was transported to the Sumter County Detention Center, where he refused to perform standardized field sobriety exercises. He agreed to a breath test, providing two samples that registered 0.047 — below the legal limit of 0.08.
Because the breathalyzer results did not match his visible level of impairment, deputies requested a urine sample. Gordon initially refused but agreed after being read the implied consent warning, admitting to deputies that marijuana would be in his system because he possesses a medical marijuana card.
Deputies provided him with water, but after waiting an hour and a half, Gordon claimed he still did not need to urinate and failed to provide a sample. The report noted Gordon also had a prior conviction for refusing to submit to testing in 2022.
Gordon is facing two felony charges for driving under the influence (third violation within 10 years) and driving with a suspended license (third or subsequent offense), as well as misdemeanor charges for refusing to submit to DUI testing and failing to register a motor vehicle.
He was booked at the jail and released after posting a $3,000 bond.
