An impassioned plea from the daughter of a deceased homeowner moved Community Development District 9 supervisors to waive fines Thursday in a year-old deed compliance case.

Homeowner Jerry Angle was cited in January 2024 for weeds and mold at his home 1764 Brandenburg Court.

The weeds were cleared within a week, but the mold on the driveway was not removed until March 1.

That delay resulted in fines of $1,087, including $137 in lien and administrative fees. Non-compliance fines are $150 plus $50 a day until violations are corrected.

Supervisors voted to waive the fines except for the fees.

In a March 31 email to Community Standards Manager Shannon Boyd, Angle’s daughter said her father passed away last November about six months after he had been diagnosed with lung cancer.

The daughter wrote that the struggle and a brain lesion affected him mentally and physically.

She lost her job a month before he died and closed on a home a day before that. She said she can’t afford to pay the fines. 

She is going through probate and plans to sell the home, according to the email.
