A homeless man won’t be prosecuted in a burglary at a hospice agency in The Villages.

Robert Eugene Marks Jr., 46, was arrested in April in connection with a burglary at Compassionate Care Hospice at 304 La Grande Blvd. on the Historic Side of The Villages. At the time, he was found to be in a possession of a backpack with the Compassionate Care logo which had been reported as stolen from the agency office, according to an arrest report from the Lady Lake Police Department. The backpack contained a hard drive, a 16GB jump drive, rolls of stamps, charging cords, pocket knives, reading glasses, tuna fish packets, essential oils and a small blue notebook.

Police were already aware of Marks as he was known to sleep without permission in structures on the Historic Side.

Last month, the prosecutor’s office decided to drop the charges of burglary and grand theft he was facing, declaring the evidence was legally insufficient.

Marks was nabbed last year in the theft of socks from Belk in The Villages.
