A complaint about an unapproved fence led to a compliant about an unapproved patio for the owners of a home at 507 St. Andrews Blvd. on the Historic Side of The Villages.

Special Magistrate Terry Neal Monday gave homeowners John Dowd and Gisele Gagnier 45 days to gain Architectural Review Committee (ARC) approval for the patio.

A complaint was received June 3 about the fence and patio. After an inspection, letters were sent to the owners.

Most of the fence was taken down after the ARC denied an application on Aug. 6 because it was higher than the permitted four feet.

The owners could face a fine without ARC approval for the patio. The other option is to tear out the concrete patio.

“It looks like the slab is in an appropriate location,” said Shannon Boyd of Community Standards.

Neighbor William Moise told Neal that the owners are snowbirds and that he helped them install and remove the fence.

He said the patio was put in long before Dowd and Gagnier bought the property.

“That slab has always been there,” he said.

Boyd said there is no record that it ever received ARC approval.
