A husband and wife from Kissimmee have filed a lawsuit against the family that owns The Legacy Restaurant at Nancy Lopez Country Club, claiming an object fell from the ceiling and hit the man while they were dining at the establishment, leading to significant head injuries.
Burton and Myra Fischel filed the complaint on Monday, March 23, in the Marion County Circuit Court against Suleiman Restaurant, Inc., which does business as The Legacy Restaurant at Nancy Lopez Country Club.
According to the lawsuit, the incident occurred on Aug. 18, 2025, while the couple was visiting the restaurant located at 17135 Buena Vista Boulevard in The Villages.
The complaint alleges that, while Mr. Fischel was dining at the premises, he was suddenly “struck in the head by a large heavy object that fell from the ceiling.”
The lawsuit accuses the restaurant of negligence, claiming the business failed to adequately maintain or inspect the ceiling and the object to ensure the conditions were safe for the public. The Fischels further allege that the restaurant failed to warn patrons of the “unreasonably dangerous condition.”
As a result of the impact, Mr. Fischel claims he suffered bodily injuries that have led to pain and suffering, disability, disfigurement, and “permanent and significant scarring.”
The suit also notes that the injuries have resulted in mental anguish, a loss of capacity for the enjoyment of life, and the “aggravation of previous existing conditions.”
The Fischels are seeking damages in excess of $50,000, exclusive of interest and costs. In addition to the negligence claim, the lawsuit includes a count for “Loss of Consortium” on behalf of Myra Fischel. She alleges that her husband’s injuries have caused a loss of companionship, affection, and aid within their marital relationship.
The Fischels have demanded a trial by jury. As of Friday, March 27, Suleiman Restaurant, Inc. has not yet filed a formal response to the allegations in court.
Suleiman Restaurant, Inc., which is owned by the Suleiman family, operates multiple restaurants in The Villages. Villages-News.com first reported that the family was taking over The Legacy Restaurant at Nancy Lopez Country Club in 2018.
In 2024, the family took over Palmer Legends Country Club, and late last year, they did the same at Boosters Bar & Gill at Shallow Creek Golf Club.
