Couple in medical facility could be facing fines for deed compliance violations

A couple that is in a medical facility and has been out of their home in the Village of Hacienda for several months is facing possible fines for deed compliance violations.

The Community Development District 1 on Friday found the homeowner on San Antonio Lane to be in violation of the deed restriction. A complaint was received Feb. 14 in regard to palm fronds, overgrown shrubbery and weeds.

Community Standards discovered that the homeowners are in a medical facility and that the utilities at the home have been shut off since December.

The board decided that if the property is not brought into compliance within five days, there will be a $150 fine for the palm fronds and overgrown shrubbery. There will also be a $50 daily accrual until the property is brought into compliance. There will also be a $250 fine for weeds. If the fines reach $1,500, the case will be turned over to District counsel.

CDD 1 Supervisor Craig Estep clearly had some misgivings about imposing the fines.

“We want to enforce compliance to keep the community nice. As I read the case, I wondered if they need more stuff piled on them,” Estep said.
